Nirbhaya Rape Case: Supreme Court Upholding Death Penalty For Nirbhaya’s Rapists

The Supreme Court has rejected the plea of the convicts in the 2012 Delhi gangrape case (the Nirbhaya gangrape case). The execution of convicts will remain intact. In the case, three of the four convicts, who had been given the death penalty, filed a reconsideration petition against the sentence in the Supreme Court. A division bench of Chief Justice Justice Dipak Mishra, Justice R Bhanumati and Justice Ashok Bhushan passed this ruling on the petitions of the accused Vinay Sharma, Pawan Gupta, and Mukesh Singh. Guilty Akshay Thakur did not file a reconsideration petition. The Supreme Court reserved the verdict on May 4 on the plea of the convicts in this case.

In the 2017 judgment of the Supreme Court, the Delhi High Court and the lower court upheld the death sentence awarded to 23-year-old Paramedic student in the case of gang-rape and murder on December 16, 2012. Ram Singh, one of the accused, allegedly committed suicide in Tihar Jail. There was also a teenager involved in the case. He was convicted by the juvenile justice board. He was released after being kept in the Recovery House for three years.

During the hearing of the case, the advocate pleading guilty to the culprits said,”this case is not a punishment for hanging. The culprits should be relieved of the hanging sentence. All are guilty of a poor family. The three are not habitual criminals. The culprits should give an opportunity to improve. The court did not agree on the single plea of the parties to the culprits. The execution sentence of the convicts was upheld while rejecting all pleas. After the retrial plea was rejected in the Supreme Court, the hanging sentence of all the convicts of the fearless case will remain intact. At the same time, the fourth convict Akshay did not file a reconsideration petition in the court. In such a situation, the execution of his hanging will remain intact.

Nirbhaya’s father Badrinath Singh has expressed his satisfaction after the Supreme Court’s decision came on the three convicts of Nirbhaya. He said that I was sure that the retrial petition would be rejected by the court. But now the culprits should not delay hanging. A lot of time has passed and Crime against women is increasing. The culprits should be hanged at the earliest as soon as possible. Hanging them is the right decision of the court. After rejecting the plea of the guilty, Nirbhaya’s mother said that after this decision our belief in the justice system has been strengthened. We have full faith in justice. It is also believed that the culprits will be hanged.
