Right to privacy Supreme Court’s verdict facilitates LGBT Section 377

Today Supreme Court came up with a landmark decision that declaring privacy as a fundamental right for all Indians. Along with the impact on the lives of individuals, this decision has also brought cheer to transgender, lesbian, Gay, Bisexual or LGBT communities. The Supreme Court indicated that the right to privacy is valid even for the Section 377. This verdict brings a severe blow to Lgbt community after four years when Delhi High Court had decriminalized homosexual sex between consenting adults, bringing it out of the ambit of Section 377. After this landmark verdict, Twitterati overflowed on Twitter by thanking Supreme Court specifically for the decision of sexual orientation part of privacy.

Right to Privacy verdict is very important and huge decision for Indians. Kavita Krishnan tweeted that Right to Privacy verdict is brilliant that unambiguously affirms fundamental rights, dignity, and equality of LGBT persons. Today’s Supreme Court verdict state that Right to privacy also includes the protection of sexual orientation lies at the core of the fundamental rights guaranteed by the article 14, 15 and 21 of the Constitution. The Judge of Supreme Court Chandrachud said that the right of a lesbian, gay, bisexual and transgender population cannot be construed to be ‘so called’ rights the expression so called seems to suggest the exercise of a liberty in the grab of a right which is illusory.

Chandrachud J suggests Suresh Kaushal section 377 IPC violates right to privacy of LGBT Indians. Sexual orientation is the essential component of identity. So, the sexual orientation of each individual in society must be protected on an even platform.
